Pharmaceutical industry is one of the most revered industries across the world of all the existent industries, for the fact that they deal with the lives of people and claim to eliminate diseases and prolong humankind’s life. Patenting a drug is primarily allowed because post-industrialization and in the current modernist globalisation period, competition is inevitable. Government authorities allow drugs to be patented to reward the researcher or discoverer or inventor for the unique contribution it gave to the world. Patents are provided to encourage competition, creative research, and break through medication discovery which enables them to own the drug exclusivity for a specific period. This specific period is substantial for a company to amass supernatural profit, because it remains the only company to sell the drug that solves a disease or its occurrence. One other important reason for patenting drugs is to instil a sense of urgency among pharmaceutical companies to rush ahead and deliver a break through medicine for a life threatening disease.
Patents allow the company to manufacture market and make profit for the drug exclusively for the patent period, and this is significant enough for pharmaceutical companies to constantly invest in research and development to deliver a solution to a particular disease (Zarocostas, 2011). Does this not raise a question that pharmaceutical companies would probably be tempted to reject an idea, a very good idea, owing to its lack of not receiving a patent? This makes the pharmaceutical companies to only focus on drugs which are patentable and will bring them consistent profits. This profit motive is the seed of such practices where the encouragement of innovation by providing patent is misused. Providing patent is promoted to encourage innovation, protect innovation, reward the innovator, and produce a drug which can save thousands of lives. The irony remains that the pharmaceutical company which produces the patented drug has the sole right to a reasonable extent to fix the pricing of the product, enabling them to garner significant profit.
